Terms of Service

I. Client Responsibilities

As the client, you agree to:

  • Notify us immediately of any changes in the number of pets.
  • Ensure timely payment of all balances due.
  • Maintain safe and unobstructed access to the service area. This includes keeping the yard free from excessive tall grass, heavy leaf accumulation, or other obstructions that would prevent service.
  • Either secure all pets indoors or in a safe, separate area during service visits, or sign the Pet Liability Waiver & Release of Responsibility if you wish to allow your pet(s) in the yard during service.
  • Acknowledge that employees of The Pile Patrol LLC are not permitted to enter any client’s home for any reason. Our insurance does not cover incidents inside a client’s home, and as such, all interactions and services must take place outdoors.
  • Ensure that gates, fences, or other entry points remain unlocked and accessible on the day of service. If our team is unable to access the yard due to locked gates, obstructed paths, or other barriers, the client may be subject to a trip fee for the missed visit. The trip fee amount will vary based on factors such as travel distance but will not exceed the full-service charge.
  • Acknowledge that service scheduling is determined based on business needs, efficiency, and operational logistics. While we strive to maintain consistency, service days and times may change from time to time. Clients will be notified in advance of any significant scheduling changes.

If our team arrives to provide service but is unable to complete the job due to conditions in the client's control (such as inaccessible yards, unrestrained pets without a waiver, or unsafe conditions), the client may be charged a trip fee instead of the full-service fee.

II. Assumption of Risk

By using our services, the client acknowledges that pet waste removal inherently involves potential risks, including but not limited to:

  • Accidental pet escape due to an improperly secured gate or enclosure.
  • The possibility of minor waste remnants being left behind due to environmental factors.
  • Exposure to environmental conditions that may affect waste removal (e.g., mud, tall grass, snow).

The client assumes all risks related to these factors and agrees not to hold The Pile Patrol LLC liable for minor oversights or uncontrollable events.

III. Indemnification Clause

The client agrees to indemnify, defend, and hold harmless The Pile Patrol LLC, its owners, employees, and representatives from any claims, damages, losses, liabilities, costs, or legal fees arising from:

  • Any pet-related incidents occurring during or as a result of service.
  • Any injury sustained by a client, visitor, or pet due to the condition of the yard before, during, or after service.
  • Any claims made by third parties related to the client’s property or pets.

This clause remains in effect indefinitely and survives the termination of service.

IV. Inclement Weather & Service Limitations

In cases of hazardous weather or unsafe conditions (such as extreme storms, heavy snowfall, or flooding), service may be delayed. We will resume service as soon as practical. If service is significantly delayed, we will notify you and work to accommodate a reschedule when possible.

Additionally, due to environmental factors beyond our control, we do not guarantee the removal of 100% of pet waste, especially in yards with tall grass, leaves, standing water, or extreme weather conditions.

V. Fees, Promotions, Service Adjustments, and Changes to Service

  • Service fees and promotional offers are subject to change.
  • If a pricing adjustment is necessary, you will receive at least two (2) weeks’ advance notice.
  • Promotional rates may be limited time offers and are not guaranteed to continue indefinitely.
  • The Pile Patrol LLC reserves the right to modify service scope, frequency, or methods based on operational needs, safety concerns, or changes in business policies. Clients will be notified of significant service modifications in advance.

VI. Payment Terms, Late Fees & Refund Policy

  • Clients are required to have a valid payment method on file.
  • Payment will be automatically charged to the payment method on file after each service is rendered.
  • If a payment method fails or is declined, the client will be notified and given 15 days to provide an updated payment method.
  • A late fee of 10% of the outstanding balance may be applied to invoices not paid within 15 days.
  • Accounts with unpaid balances beyond 30 days may be suspended, and service will not resume until full payment is received.
  • All payments for rendered services are non-refundable. Credits or reschedules may be issued at the sole discretion of The Pile Patrol LLC.

VII. Service Termination

  • Either party may terminate service at any time with written notice.
  • Any unpaid balances must be settled within 15 days of termination.
  • Late payments may be subject to additional fees as outlined in Section VI.

VIII. Force Majeure Clause

We are not responsible for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, extreme weather, government regulations, labor strikes, or supply chain disruptions.

IX. Agreement Acceptance

By initiating service, you acknowledge that:

1.   You have read, understood, and agreed to these terms.

2.   You assume all risks related to pet waste removal.

3.   You release The Pile Patrol LLC from liability for minor oversights, weather-related limitations, and risks inherent in service.

4.   You agree to automatic payment processing and acknowledge that a valid payment method must remain on file for continued service.
